By virtue of an Order of Sale No. CV2017 03 1151 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

And known as being part of Tract #7, in said township and bounded and described as follows:

Beginning at a point on the centerline of Hayne Road (T.R. #140) said point being S. 89 deg. 05' 21" E., a distance of 656.81 feet from its intersection with the centerline of the Krumroy-Myersville Road (C.H. #184); thence continuing S. 89 deg. 05' 21" E., along said centerline of Hayne Road, a distance of 227.20 feet to a point; thence S. 0 deg. 54' 39" W., a distance of 673.09 feet to a point; thence N. 87 deg. 50' 35" W., a distance of 227.25 feet to a point; thence N. 0 deg. 54' 39" E., a distance of 668.15 feet to the place of beginning and containing 3.4978 acres of ground as described by Jere G. Medley, Reg. Prof. Surveyor #4541 in June 1965.

Medley, Reg. Prof. Surveyor #4541 in November 1970.

Property appraised at: One Hundred Twenty Thousand Dollars ($120,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
