By virtue of an Order of Sale No. CV2017 05 2126 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 20TH DAY

OF OCTOBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Norton, (formerly Norton Township), County of Summit and the State of Ohio and being known as part of Original Township Lot 64 and further described as follows:

Beginning at the Southeast corner of the City Farms Subdivision No. 2, the same shown on Plat Book 36, Page 21 as recorded in the Summit County Recorder's Office also being the Southeast corner of Hoctor Avenue (50' wide) and Roop Avenue (50' wide), and being in the North line of Original Township Lot 64, said center being referenced by a 1" iron pipe found; thence N. 00 deg. 09' 00.0" E., along the East line of said Roop Avenue, a distance of 591.00 feet to 5/8" rebar set and being the true place of beginning of the parcel herein described; thence N. 00 deg. 09' 00.0" E., continuing along the East line of Roop Avenue, a distance of 125.00 feet to 5/8" rebar set; thence S. 89 deg. 33' 27.3" E., a distance of 612.972 feet to a 5/8" rebar set in the West line of the lands now or formerly owned by the Ohio Edison Company (D.V. 2692, Pg. 19); thence S. 02 deg. 53' 29.7" W., along the West line of said Ohio Edison lands, a distance of 125.113 feet to a 5/8" rebar set; thence N. 89 deg. 33' 27.3" W., a distance of 606.988 feet to the true place of beginning and containing 1.750 acres of land as surveyed in May 1998 by John David Jones, Professional Surveyor No. 4362, but subject to all legal highways and any restrictions, reservations or easements of record. All 5/8" rebar set are marked with a yellow plastic cap stamped "The JDJ Corp Ohio 4362". The basis of bearing for this survey is N. 0 deg. 09' 00" E., as the East line of Roop Avenue, the same shown on City Farms Subdivision No. 2 as recorded on P.B. 36, Pg. 21, Summit County Recorder's Office.

Situated in the City of Norton (formerly Norton Township), County of Summit and State of Ohio and known as part of Original Township Lot 64 and further described as follows:

Beginning at the Southeast corner of the City Farms Subdivision No. 2, the same shown on Plat Book 36, Page 21 as recorded in the Summit County Recorder's Office also being the Southeast corner of Hoctor Avenue (50' wide) and Roop Avenue (50' wide), and being the South line of Original Township Lot 64, said corner being referenced by a 1" iron pipe found; thence N. 00 deg. 09' 00.0" E., along the East line of said Roop Avenue, a distance of 125.00 feet to a 5/8" rebar set; and the true place of beginning of the parcel herein described; thence N. 00 deg. 09' 00.0" E., continuing along the East line of said Roop Avenue, a distance of 466.00 feet to a 5/8" rebar set; thence S. 89 deg. 33' 27.3" E., a distance of 606.988 feet to a 5/8" rebar set in the West line of the lands nor or formerly owned by the Ohio Edison Company (D.V. 2962, Page 19; thence S. 02 deg. 53' 29.7" W., along the West line of said Ohio Edison lands, a distance of 464.018 feet to a rebar set; thence N. 89 deg. 47' 33.9" W., a distance of 584.785 feet to the true place of beginning and containing 6.358 acres of land as surveyed in May of 1998 by John David Jones, Professional Surveyor No. 4362 but subject to all legal highways and any restrictions, reservations or easements of record. All 5/8" rebar set are marked with a yellow plastic cap stamped "The JDJ Corp Ohio 4362". The Basis of Bearing for this survey is N. 0 deg. 09' 00" E., as the East line of Roop Avenue, the same shown on City Farms Subdivision No. 2 as recorded on P.B. 36, Pg. 21, Summit County Recorder's Office.

Property located at: 4429 Roop Avenue, Norton, OH 44203.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 3rd day of November, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
