By virtue of an Order of Sale No. CV2017 11 4765 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 4TH DAY

OF MAY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Springfield Township, County of Summit and State of Ohio:

Also known as being part of Tract 7 in said township, and more fully described as follows:

Beginning at a mag nail found monumenting the intersection of the centerline of Maxwell Road (T.R. 402, 50 feet wide) and Farmdale Road (T.R. 400, 50 feet wide); thence with the centerlines of said Farmdale Road N. 89 deg. 56' 10" W., 160.00 feet to a point and the true place of beginning for the parcel herein to be conveyed. Thence the following:

N. 89 deg. 56' 10" W., 135.00 feet continuing with the centerline of said Farmdale Road to a point; N. 1 deg. 12' 50" W., 217.00 feet along an East line of lands of John and Helen Whetzel (Parcel No. 5107680) to an iron pipe found, and passing over an iron pinch-top pipe found 25.00 feet from said road centerline; S. 89 deg. 56' 10" E., 135.00 feet along a South line of lands of Healing Stripes, Inc. (Parcel No. 5103129) to an iron pipe found; S. 1 deg. 12' 50" E., 217.00 feet along a Westerly line of lands of said Healing Stripes, Inc. and a West line of lands of Elma F. Hershberger (Parcel No. 5103221) to a point on the centerline of said Farmdale Road, the true place of beginning and passing over an iron pipe found 25.00 feet therefrom. Containing 0.6722 acres of land, of which 0.0774 acres is in road right-of-way, be the same, more or less, but subject to all legal highways, easements, and limitations of record, if any, as surveyed and determined from local records and monumentation in June, 2006 by Douglas E. Bedore, P.S. 6023, of Bedore Surveying, Inc. All hearings are to an assumed meridian, and are used to form angles only.

Property appraised at: One Hundred Fourteen Thousand Dollars ($114,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of May, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
