By virtue of an Order of Sale No. CV2017 09 3977 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 4TH DAY

OF MAY, A.D., 2018,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit, State of Ohio, and is described as follows;

Part of Tract 9, Lots 2 and 3, formerly Township of Tallmadge, and being further described as follows:

Beginning at a point in the West line of Lot 3, South 2 deg. 38' East, 350.70 feet from the Northwest corner of said Lot 3; thence South 87 deg. 22' East, 140.49 feet to a point which is the Northwest corner of Lot No. 261 in the Hine Heights Allotment (proposed); thence South along the East line of said Lot No. 261, a distance of 50 feet to a point in the Southeast corner thereof; thence North 87 deg. 22' West along the Southerly line of Lot No. 261, a distance of 165.36 feet to a point in the center line of a proposed street known as Brownstone Avenue; thence North 2 deg. 38' West 50 feet along the center line of Brownstone Avenue to a point; thence South 87 deg. 22' East, 25 feet to the true place of beginning and containing about 0.19 of an acre of land.

Beginning at the Northeast corner of said Lot 2, Tract 9, said point being the intersection of the South line of Tallmadge Avenue (60.00 feet wide) and the East line of Brownstone Avenue (50 feet wide); thence North 87 deg. 12' West, a distance of 25.00 feet to a point in the center line of said Brownstone Avenue (50 feet wide); thence South 2 deg. 38' East along the center line of said Brownstone Avenue 350.70 feet to a point being the true place of beginning; thence continuing South 2 deg. 38' East along the center line, a distance of 50.00 feet to a point; thence South 87 deg. 22' East, a distance of 25.00 feet to a point in the East line of said lot and Brownstone Avenue; thence North 2 deg. 38' West along the East line of said lot and Brownstone Avenue, a distance of 50.00 feet to the point; thence North 87 deg. 22' West, a distance of 25.00 feet to the place of beginning and containing an area of 0.029 acres of land. The above strip of land is the East 25.00 feet to the parcel of and to be used for street purposes lying adjacent to Lot No. 261 of Hine Heights (unrecorded) and described in Book 114, Page 35060, Summit County Registered Lands.

Property appraised at: Fifty-four Thousand Dollars ($54,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of May, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
