By virtue of an Order of Sale No. CV2016 12 5345 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 18TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

The following described premises, situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot 6, Tract 10, formerly Tallmadge Township and more fully described as follows:

Commencing at a monument in the centerline of Olallz Avenue (50 feet wide), in the Eastland Woods Allotment, as recorded in Plat Book 121, Pages 6-10 of the Summit County Records of Plats, said monument also being S. 41 degrees 00' 00" E., 75.41 feet from the centerline of Eastland Avenue (60 feet wide); thence N. 41 degrees 00' 00" W., along said Olalla Avenue centerline 45.41 feet to a point; thence S. 49 degrees 00' 00" W., along the Southerly right-of-way of said Eastland Avenue, 179.23 feet to an iron pin set and true place of beginning for the parcel hereon described; thence S. 41 degrees 00' 00" E., a distance of 200.00 feet to an iron pin set on the Northwesterly line of said Eastland Woods Allotment; thence S. 49 degrees 00' 00" W., along the said allotment line, 60.00 feet to an iron pin set at the Southeasterly corner of property owned A. L. & I. Clough; thence N. 41 degrees 00' 00" W., along said Clough property, 200.00 feet to an iron pin found on said Southerly right-of-way of Eastland Avenue; thence N. 49 degrees 00' 00" E., along said right-of-way, 60.00 feet to true place of beginning and containing about 0.2755 acres of land based on a survey made by Randell J. Capatosto, Registered Land Surveyor No. 7570 in January, 1996. The basis of bearings hereon shown is the bearings on the centerline of Eastland Avenue as recorded on the Eastland Woods Allotment Plat, Plat Book 121, Pages 6-10 of the Summit County Records of Plats.

Property located at: 1197 Eastland Avenue, Akron, OH 44305.

Property appraised at: One Hundred Two Thousand Dollars ($102,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 1st day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
