By virtue of an Order of Sale No. CV2016 10 4524 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 25TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of New Franklin (formerly Village of New Franklin), County of Summit and State of Ohio:

And known as being a part of the Northeast quarter of Section 12, Franklin Township and further described as follows:

Beginning at the Northwest corner of Lot 75 of the Turkeyfoot Channel Allotment, First Addition, Plat Book 29, Page 66; thence N. 70 deg. 11' W., a distance of 84.61 feet to the true place of beginning; thence S. 12 deg. 24' W., 230.31 feet to a pipe; thence N. 70 deg. 11' W., 54.86 feet to a pipe; thence N. 05 deg. 13' E., 251.33 feet to the center of Lynn Drive; thence S. 70 deg. 11' E., along said center, 64.19 feet to a point; thence S. 13 deg. 05' W., a distance of 15.01 feet to a pipe; thence S. 70 deg. 11' E., a distance of 22.52 feet to the place of beginning and containing 0.3873 acres of land as surveyed by Richard F. Paul, Registered Surveyor #4351, in October 1973. Subject to all legal highways.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 8th day of June, 2018. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
