By virtue of an Order of Sale No. CV2022 05 1440to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit, State of Ohio:

Being part of former Tallmadge Township Lot 1, Tract 13, being part of parcel of land now or formerly in the name of Habitat of Humanity of Greater Akron, Inc. as recorded in OR585-661 of the Summit County Records of Deeds, and more fully described as follows:

Commencing for reference in the centerline intersection of Brandon Ave. (45 feet wide) and Hazel Street (60 feet wide); thence South 89 degrees 14 minutes 25 seconds East, along the centerline of Brandon Ave., a distance of 39.00 feet to a point; thence North 40 degrees 28 minutes 46 seconds East, along the Southeasterly right-of-way line of Hazel Street and its Southwesterly projection, a distance of 294.90 feet to the Southwesterly corner of aforesaid Habitat for Humanity of Greater Akron, Inc. and the true place of beginning of the parcel herein to be described (a 3/4 inch pinch-top pin was found North 49 degrees 09 minutes 42 seconds East at 0.67 feet); thence North 40 degrees 28 minutes 46 seconds East continuing along said right-of-way line of Hazel Street, a distance of 60.00 feet to a 5/8 inch rebar with I.D. cap set; thence South 49 degrees 07 minutes 06 seconds East, a distance 01131.42 feet to a rebar with I.D. cap "City of Akron" found; thence South 00 degrees 58 minutes 52 seconds West, along a Westerly line of Montgomery Heights Allotment as recorded in Plat Cabinet A, Slides 384-385 and passing over a rebar with I.D. cap "City of Akron" was found at 45.47 feet, a distance of 78.03 feet to a 5/8 inch rebar with I.D. cap set (a rebar with I.D. cap "City of Akron" was found South 00 degrees 58 minutes 52 seconds West at 87.88 feet); thence North 49 degrees 09 minutes 42 seconds West, along the Northwesterly line of a parcel of land, now or formerly in the name of the Jewish Community Federation of Cleveland as recorded in OR 012-373, a distance of 181.05 feet to the place of beginning. Said parcel contains 0.215 acre of land, more or less, as surveyed in May of 1991, under the supervision of Robert A. Darner, R.L.S. 6943 of Campbell & Associates, Inc. The basis of bearings for this described is South 60 degrees 43 minutes 38 seconds West as the centerline of Hazel Street, Southwest of Grifton Ave., as evidenced by drill holes found and is the same bearing as shown on a map of survey dated February 18, 1985, by Bruce J. Campbell, P.S. No. 5096.

Property appraised at: Fifty-four Thousand Dollars ($54,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

https://summit.sheriffsaleauction.ohio.gov on the 2nd day of December, 2022. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
