By virtue of an Order of Sale No. CV2018 07 2742 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 10TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Cuyahoga Falls, County of Summit and State of Ohio:

And known as being a part of Van Buran Avenue as vacated and a part of Lot Number 28 (Twenty-eight) of the Warner's Corner Allotment as recorded in Plat Book 32, Pages 50 to 52 of the Summit County Record of Plats and more fully described as follows:

Beginning at a point on the West line of Lot Number 28, which is North, a distance of 23.80 feet from the point of intersection of the South and West lines of Lot Number 28; thence South 89 deg. 27' East, a distance of 185.01 feet to a point on the fact line of Lot Number 28; thence South along the East line of Lot Number 28 and South extension thereof, a distance of 50.00 feet to a point; thence North 89 deg. 2" West, a distance of 185.01 feet to a point on the Southerly extension of the West line of Lot Number 28; thence North along the West line of Lot Number 28 and Southerly extension thereof, a distance of 50.00 feet to the place of beginning, also being Job Number 56 of Sublot Number 56 in an unrecorded plat of the Warner's Corners Allotment, Cuyahoga Falls, Ohio. Made for the Friedhaven Construction Company, Akron, Ohio. Also vacated Ordinance 41-1930.

Property appraised at: Ninety-three Thousand Dollars ($93,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 24th day of May, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
