By virtue of an Order of Sale No. CV2018 01 0259 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

 

FRIDAY, THE 17TH DAY

OF MAY, A.D., 2019

 

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and the State of Ohio:

TRACT ONE:

And known as being a part of Lot 6, Tract 6 in said township and also being a part of Lot 10 Chenowith Little Farms Allotment (unrecorded) and bounded and described as follows:

Beginning at a point on the center line of Pressler Road, said point being South 5 deg. West and one thousand seven hundred forty two (1,742) feet distant from the Northwest corner of Lot 6 as measured along the road center line; thence South 85 deg. 30 minutes East, a distance of 1190 feet to a point; thence South 5 deg. West, a distance of 88 feet to an iron stake; thence North 85 deg. 30 minutes West along the South line of Lot 10, Chenowith Little Farms Allotment (unrecorded) a distance of 700 feet to a point; thence North 5 deg. East, 78 feet to a point; thence North 85 deg. 30 minutes West, a distance of 490 feet to a point on the center line of Pressler Road; thence North 5 deg. East along road center line, a distance of 10 feet to a point and the place of beginning and containing within said boundaries 1.527 acres of land, be the same more or less, but subject to all legal highways.

Excepting therefrom the above described parcel an easement over a parallel strip of land, 10 feet in width off the North side, the same being the South half of a 20 foot private driveway, extending 500 feet Eastward from the center line of Pressler Road, to be used in common with others for private driveway purposes only. Said driveway to be used for the benefit of the above named Grantees together with the Grantees of the North on half of said private driveway and their heirs, executors, administrators or assigns of the Grantees of each half of said private driveway and shall be jointly maintained by them.

Situated in the Township of Springfield, County of Summit and State of Ohio:

And known as being a part of Lot 6, Tract 6, in said township and also being a part of Lot 10 Chenowith Little Farms Allotment (unrecorded) and bounded and described as follows:

Beginning at a point on the center line of Pressler Road, said point being South 5 deg. West and one thousand seven hundred forty two (1,742) feet distant from the Northwest corner of Lot 6 as measured along said road center line; thence South 85 deg. 30' East, a distance of four hundred ninety (490) feet to the place of beginning; thence continuing South 85 deg. East, a distance of two hundred forty seven and five tenths (247.5) feet to a iron pin; thence South 5 deg. West, a distance of eighty eight (88) feet to an iron pin; thence North 85 deg. 30' West along the South line of Lot 10 Chenowith Little Farms (unrecorded) a distance of two hundred forty seven and five tenths (247.5) feet to a point; thence North 5 deg. East, a distance of eighty eight (88) feet to the place of beginning. Excepting from the above described parcel a parallel strip of land, ten (10) feet in width off the North side and extending from the East property line to the West property line of the above described parcel. This ten (10) foot strip to be an extension of an existing (10) foot strip as described in Volume 3060, Page 606, of Summit County Records, said strip or driveway to be used in common with others for private driveway purposes only. Said driveway to be for the benefit of the above Grantees, their heirs, executors, administrators or assigns of the Granters and shall be jointly maintained by them and others using said private driveway. The above described parcel containing one half (0.5) acres more or less. Be the same more or less, but subject to all legal highways.

Property appraised at: Thirty Thousand Dollars ($30,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 31st day of May, 2019. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
