By virtue of an Order of Sale No. CV2019 12 4572to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

And known as being Lot No. 37 in the Fouse Homestead Allotment as surveyed and numbered by J. A. Gehres and recorded in Plat Book 24, Page 33 of the Summit County Records of Plats, be the same more or less, but subject to all legal highways.

Excepting and reserving the following:

And known as being a part of Sublot 37 of the Homestead Allotment as recorded in Plat Book 24, Page 33 of the Summit County Records; beginning at the Northeast corner of said Sublot 37, said point also being the Northwest corner of Sublot 36, said point being witnessed by an iron pin found; thence S. 02 deg. 31' 33" W., along the East line of said Sublot 37, a distance of 97.74 feet to an iron pin set at the Southwest corner of said Sublot 37; thence N. 87 deg. 29' 00" W., along the South line of said Sublot 37, a distance of 26.68 feet to an iron pin set; thence N. 02 deg. 31' 33" E., along a line parallel to the East line of said Sublot 37, a distance of 97.87 feet to an iron pin set in the North line of said Sublot 37 and the South right of way line of Floyd Avenue; thence S. 87 deg. 13' 00" E., along the South right of way line of said Floyd Avenue, a distance of 26.68 feet to the place of beginning and containing within said bounds 0.0599 acres of land, be the same more or less, but subject to all legal highways, as surveyed by Carl M. Clark, Registered Surveyor No. 6358 of Bock & Clark, Inc., in May, 1981.

Property appraised at: One Hundred Two Thousand Dollars ($102,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 22nd day of October, 2021. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
