By virtue of an Order of Sale No. CV2016 01 0575 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 5TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Lot Nos. 140 and 139 of the William A. Johnston's Allenside No. 1 Allotment as recorded in Plat Book 24, Pages 48, 49 and 50 of Summit County Records of Plats, bounded and described as follows, to-wit:

Beginning at a point in the South line of Lot 139, which point is also in the North line of Lockwood Street, 12 feet Easterly from the Southwest corner to said Lot 139; thence Easterly along the South line of Lots 139 and 140, which South line is also the North line of Lockwood Street, 46.00 feet to a point which is 13.00 feet Easterly from the Southwest corner of said Lot 140; thence North parallel to the West line of Lot 140, a distance of 149.72 feet to the North line of said Lot 140; thence Westerly along the North line of Lots 140 and 139, a distance of 46.20 feet to an iron pin in the North line of said Lot 139, said pin being 12.00 feet Easterly from the Northwest corner of said Lot 139; thence South parallel to the West line of said Lot 139, a distance of 146.68 feet to the place of beginning.

Property appraised at: Sixty Thousand Dollars ($60,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 19th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
