By virtue of an Order of Sale No. CV2016 01 0509 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 12TH DAY

OF MAY, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

Known as being all of Lots 81 and 82 in the V. D. Emmons Trustee Allotment as recorded in Plat Book 14, Page 18, Summit County Records of Plats, further bounded and described as follows:

Beginning at a drill hole set in the concrete walk at the Northeast corner of Lot 81, and in the West line of Ardella Ave., 45 feet wide:

Course 1: Thence South 01 deg. 10 min. 00 sec. West, along the East line of Lots 81 and 82 and the West line of Ardella Ave., a distance of 84.00 feet to a drill hole set in the concrete walk at the Southeast corner of Lot 82;

Course 2: Thence North 88 deg. 50 min. 00 sec. West, along the South line of Lot 82, a distance of 120.00 feet to a point in the chain link fence post found at the Southwest coner of Lot 82;

Course 3: Thence North 01 deg. 10 min. 00 sec. East, along the West line of Lots 82 and 81, a distance of 84.00 feet to a point (witness a #5 rebar with I.D. Cap #6541 set 6" high South 88 deg. 50 min. 00 sec. East, a distance of 4.00 feet from point described) and the Northwest corner of Lot 81;

Course 4: Thence South 88 deg. 50 min. 00 sec. East, along the North line of Lot 81, a distance of 120.00 feet to the place of beginning and containing 10,080 S. F. or 0.2314 acres of land, but subject to all legal rights, easements and restrictions of record as surveyed in March, 2006 by John W Patrick Jr., Professional Land Surveyor #6541.

The "Basis of bearings" is assumed and the bearings shown are to denot angles only.

Deed Reference Number: Dated May 1, 2008, filed May 2, 2008, recorded as Instrument Number 55539100, Summit County, Ohio records.

Property located at: 468 Ardella Avenue, Akron, OH 44306.

Property appraised at: Sixty Thousand Dollars ($60,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 26th day of May, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
