By virtue of an Order of Sale No. CV2016 09 4165 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 9TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Norton, County of Summit and State of Ohio:

And known as being a part of Original Lot 5, formerly Norton Township and also known as being part of a parcel conveyed to Mark and Carrie Milkovich as recorded in Reception No. 54858016 and being more fully described as follows, to wit:

Beginning at the centerline of the intersection of Reimer Road (C.H. 211) and Cleveland Massillon Road (C.H. 17) 60' R/W; thence North 02 deg. 08' 00" East, 330.00', along the centerline of Cleveland Massillon Road, to the Northeast corner of a parcel conveyed to Milo Milkovich as recorded in Reception No. 54508233 and being the true place of beginning for the parcel hereinafter described; thence North 88 deg. 0' 00" West, 351.48', along the North line of said Milo Milkovich parcel (passing over a 3/4" pipe found at 30.00') to a 5/8" rebar with "C&A" cap found; thence North 01 deg. 51' 39" East, 150.00' along a new division line to a 5/8" rebar with cap set in the Southerly line of a parcel conveyed to Carlisle Keith as recorded in D.V. 7142, Page 427; thence South 88 deg. 00' 00" East, 351.19', along the South line of said Keith parcel, to a point in the centerline of Cleveland Massillon Road (witness a 1/2" pipe found 0.60' South of said line and 31.18' West a centerline); thence South 02 deg. 08' 00" West, 150.00'. To the true place of beginning and containing 1.212 acres of land, of which 0.103 acres lie within a right of way, more or less, as determined from a survey made by Stephen P. Campbell, Professional Land Surveyor No. 7330 of Campbell & Associates, Inc. in February, 2004. The basis of bearing used to prepare this description are based on South 02 deg. 08' 00" West the centerline of Cleveland Massillon Road as recorded in Reception No. 54508233.

Deed Reference Number: Dated January 17, 2009, filed January 26, 2009, recorded as Instrument Number 55597333, Summit County, Ohio records.

Property located at: 3048 Cleveland Massillon Road, Barberton, OH 44203.

Property appraised at: One Hundred Sixty-seven Thousand Dollars ($167,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 23rd day of June, 2017. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
