By virtue of an Order of Sale No. CV2016 09 4079 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 30TH DAY

OF JUNE, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Barberton, County of Summit and State of Ohio:

And being a part of O.L. 95 formerly of Norton Township and more fully described as follows:

Beginning at the Southeast corner of O.L. 95 (said point being the intersection of the centerlines of Eastern Road and 31st Street S.W. formerly Kungle Road); thence North 4 degrees 53 minutes East along the line of O.L. 95 and centerline of 31st Street S.W., a distance of 1385.28 feet to the true place of beginning; thence North 85 degrees 25 minutes West, a distance of 337.55 feet to an iron pin; thence North 4 degrees 53 minutes East, a distance of 75.00 feet to an iron pin; thence South 85 degrees 25 minutes East, a distance of 337.55 feet to a point on the centerline of 31st Street S.W.; thence South 4 degrees 53 minutes West along said centerline, a distance of 75.00 feet to place of beginning and containing 0.5812 of an acre as surveyed by Jack W. Bell, P.L.S. 5342.

Property located at: 488 31st Street, Barberton, OH 44203.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 14th day of July, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
