By virtue of an Order of Sale No. CV2016 12 5252 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 4TH DAY

OF AUGUST, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Tallmadge, County of Summit and State of Ohio:

And known as being a part of Lot Eight (8), Tract Ten (10) of said city and more particularly described as follows:

Beginning at the intersection of the South line of Tallmadge Public Square and the Southeasterly line of the highway leading Southwest from the said Tallmadge Public Square; thence along the said Southeasterly line of said public highway, South 49 deg. 30' West, 1029.68 feet to a point, which point is the true beginning point of the land herein conveyed; thence South 32 deg. 48' East, 509.96 feet to a point in the Northerly right-of-way of the Erie Railroad; thence South 75 deg. 53' West along said Northerly right-of-way line of said Erie Railroad 179.52 feet to a point; thence North 29 deg. 12' West, 433.95 feet to a point in the Southeasterly line of said public highway; thence North 49 deg. 30' East along said Southeasterly line of said public highway, 144.18 feet to the true place of beginning, and containing one and seventy one-hundredths (1.70) acres.

Notwithstanding the reference to acreage or square footage in the description set forth in Schedule A hereof, this policy does not insure nor guarantee the acreage or quanity of land set forth therein.

Property located at: 105 Southwest Avenue, Tallmadge, OH 44278.

Property appraised at: Ninety Thousand Dollars ($90,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 18th day of August, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
