By virtue of an Order of Sale No. CV2016 12 5113 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 29TH DAY

OF SEPTEMBER, A.D., 2017,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Sagamore Hills, County of Summit and State of Ohio:

And known as being a part of Northfield Township, Original Lot No. 74 and bounded and described as follows:

Beginning at an iron pin in the center line of Nesbitt Road which bears North 88 deg. 25' 15" West along the Northerly line of Original Lot No. 74, a distance of 421.25 feet from an iron pin at the Northeasterly corner of said original lot which is also the Northeasterly corner of land conveyed to M. D. Gannett by deed dated Jan. 8, 1943 and recorded in Vol. 1990, Page 124 (First Parcel) of Summit County Records.

Course No. 1

Thence South 1 deg. 34' 45" West, 30 feet to a point from which an iron pin bears North 88 deg. 25' 15" West, 30 feet and continuing South 1 deg. 34' 25" West, 601.58 feet in the centerline of a right of way in common 60 feet wide (for road purposes) to a point;

Course No. 2

Thence North 88 deg. 25' 15" West, 30 feet to a point from which an iron pin bears North 1 deg. 34' 45" East 30 feet and continuing North 88 deg. 25' 15" West in the centerline of a right of way in common 60 feet West 170 feet to a point;

Course No. 3

Thence North 1 deg. 34' 45" East, 601.58 feet to an iron pin and continuing on the same course, 30 feet to a point in the centerline of Nesbitt Road;

Course No. 4

Thence South 88 deg. 25' 15" East, 200 feet in the centerline of Nesbitt Road to the place of beginning, be the same more or less, but subject to all legal highways.

Property located at: 956 Nesbitt Road, Sagamore Hills, OH 44067.

Property appraised at: Two Hundred Nineteen Thousand Dollars ($219,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 13th day of October, 2017. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
