By virtue of an Order of Sale No. CV2021 11 3760to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

 

FRIDAY, THE 10TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Township of Springfield, County of Summit and State of Ohio:

Known as being a part of Tract 5 of said township and more fully described as follows:

Beginning at an iron pipe at the intersection of the center line of Hilbish Avenue with the center line of Triplett Blvd.; thence South 0 deg. 35' West along the center line of Hilbish Avenue 1,343.19 feet to an iron pipe at the intersection of said center line with the center line of a proposed 50 feet street, said 50 foot street now known as Delaware Avenue (T.R. 380); thence South 89 deg. 50' 20" East along the center line of the proposed 50 feet street 736.27 feet to the place of beginning for the within described parcel; thence South 89 deg. 50' 20" East along the center line of the said proposed street 245.41 feet; thence North 0 deg. 35' East parallel with the center line of said Hilbish Avenue 177.50 feet to an iron pipe; thence North 89 deg. 50' 20" West 245.41 feet to an iron pipe and thence South 0 deg. 35' West 177.50 feet to the place of beginning as surveyed August 9, 1937, by S. G. Swigart and Son, subject to restrictions as recorded.

Excepting and reserving from the above described premises the following parcel of land:

Beginning at a point which is the Southeast corner of the above-described parcel; said beginning point being also 981.68 feet Easterly along the center line of Delaware Avenue from its intersection with the center line of Hilbish Avenue; thence North 0 deg. 35' East, parallel with the center line of Hilbish Avenue, 177.50 feet to an iron pipe; thence North 89 deg. 50' 20" West 100 feet to a point; thence South 0 deg. 35' West, 177.50 feet to a point in the South line of the above described premises; thence South 89 deg. 50' 20" East, 100 feet to the place of beginning.

Property appraised at: One Hundred Eleven Thousand Dollars ($111,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 24th day of February, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
