By virtue of an Order of Sale No. CV2022 04 1350 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Green, County of Summit and State of Ohio:

And known as being part of the Northwest quarter of Section Number 24 more fully described as:

Beginning at a point on the center line of Heckman Road, said beginning point being S. 83 deg. 22' E., 643.70 feet measured along said road center line from its intersection with the tangent center line of Mayfair Road and thence along the center line of said Heckman Road, South 83 deg. 22' E., 152.50 feet (an iron pipe is S. 6 deg. 00' W., 30.0 feet from this point); thence S. 6 deg. 00' E., 607.92 feet to an iron pipe on the North line of a parcel of land as deeded to B. W. McCourtney by deed recorded in Volume 2091, Page 175; thence along said line N. 83 deg. 21' W., 152.20 feet to an iron pipe; thence N. 6 deg. 00' E., 607.88 feet to the place of beginning (an iron pipe is S. 6 deg. 00' E., 30.0 feet from this point) and containing 2.125 acres of land as surveyed in April 1948 by Gehres and Kingsley, Surveyors. Also known as Parcel "D" of the Bartlett and Hodges Subdivision, unrecorded.

Being the same property as conveyed from Margaret A. George, widowed and not remarried to David U. George, a single man, as described in Instrument No. 55325690, dated 5/17/2006, recorded 5/24/2006.

Note:

The above legal description is taken from deed in Instrument No. 54686291 recorded 04/12/2002 as the legal description attached to the current vesting deed and the mortgage sought in foreclosure contains scrivenor's errors, namely "South 83 degrees 22 feet East" which should be "South 83 degrees 22' East", South 83 degrees 22 feet East" which should be "South 83 degrees 22' East", South 6 degrees 00 feet West" which should be "South 6 degrees 00' West", North 83 degrees 21 feet West" which should be "North 83 degrees 21' West", North 6 degrees 00 feet East" which should be "North 6 degrees 00' East", and "South 6 degrees 00 feet East" which should be "South 6 degrees 00' East", "Volume 209" which should be "Volume 2091", and "containing 2.15 acres" which should be "containing 2.125 acres". In deeds subsequent to Deed Instrument No. 54686291 was translated to feet when it should have been translated to minutes, reformation may be required.

Property appraised at: Ninety Thousand Dollars ($90,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

on the 3rd day of March, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
