By virtue of an Order of Sale No. CV2022 08 2586to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

And known as being part of the S. E. 1/4 of Section 29 of said township also known as being a part of a parcel of land deeded to Russell V. Miller and Nancy Miller, recorded in Deed Volume OR 1067-736 of the Summit County Records, more fully bounded and described as follows:

Beginning at the S.E. corner of said Section 29 (a P.K. nail found 0.05' N. and 0.18' W. thereof) and in the centerline of S. Arlington Road 60 feet wide; thence along the East line of said section and road centerline N. 02 deg. 48' 28" W., a distance of 1047.3 feet to a point in the centerline Killinger Road, 60 feet wide; thence continuing along the side section line and road centerline N. 02 deg. 50' 37" W., a distance of 805.65 feet to a point therein and the true place of beginning for the parcel of land herein described; thence from the true place of beginning S. 86 deg. 03' 16" W., a distance of 449.37 feet to a 5/8 rebar set; thence N. 02 deg. 51' 01" W., a distance of 161.04 feet to a 5/8 rebar set; thence along the North line of said Miller Parcel N. 87 deg. 03' 05" E., a distance of 449.62 feet to the centerline of aforesaid S. Arlington Road (passing over a 5/8" I.P. set at the intersection with the West right of way line of S. Arlington at 30.00 feet thereof); thence along said road centerline S. 02 deg. 50' 37" E., a distance of 161.29 feet to the true place of beginning, containing 1.6626 acres of land, more or less as surveyed by Gaskill & Associates, Inc., September 1994. Be the same more or less, but subject to all legal highways.

Property appraised at: One Hundred Sixty-eight Thousand Dollars ($168,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

https://summit.sheriffsaleauction.ohio.gov on the 3rd day of March, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
