By virtue of an Order of Sale No. CV2022 02 0579to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

 

FRIDAY, THE 3RD DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being all of Lot Number 163 in the Goodview Park Allotment as recorded in Plat Book 28, Pages 10 to 13 of Summit County Records, be the same more or less, but subject to all legal highways.

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being part of Sublot 206 and 207 of Goodview Park Allotment, as recorded in Volume 28, Page 10-13 of the Summit County Records of Plats, and more fully described as follows:

Commencing for reference at a 1/2 inch pipe found on the Northeasterly right of way of Cluster Avenue (45 feet wide) at the most Southerly corner of Sublot 208 of said Goodview Park Allotment; thence Southeasterly along said right of way following the arc of a curve to the right, having a central angle of 14 deg. 37' 08", a radius of 312.50 feet, a tangent of 40.08 feet, a chord of 79.52 feet, a chord bearing South 37 deg. 41' 26" East, a distance of 79.74 feet to the most Southerly corner of Sublot 206; thence North 59 deg. 45' 39" East, along the Southerly line of said Sublot and passing over a 1/2 inch pipe found at 0.13 feet, a distance of 94.13 feet to a 5/8 inch rebar with ID cap at place of beginning of the parcel herein to be described; thence North 05 deg. 16' 31" West, a distance of 62.22 feet to a 5/8 inch rebar with ID cap set on the Easterly line of Sublot 207; thence South 33 deg. 08' 22" East along the Easterly lines of Sublots 207 and 206 and passing over the Southeasterly corner of Sublot 207 at 0.41 feet, a distance of 56.48 feet to a 1/2 inch pinch top pin found at the Southeasterly corner of Sublot 206; thence South 59 deg. 45' 39" West along the Southerly line of Sublot 206, a distance of 29.12 feet to the place of beginning. Said parcel contains 0.019 acre of land, more or less and subject to all legal highways as surveyed in September of 1991, under the supervision of Robert A. Dorner, R.L.S. 6943 of Campbell & Associates, Inc. The basis of bearings for this description is North 45 deg. 00' 00" East, as the Southerly line of Sublot 208, as evidence by monuments found and is an assumed bearing.

Property appraised at: Ninety-nine Thousand Dollars ($99,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 17th day of March, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
