By virtue of an Order of Sale No. CV2022 02 0608to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the County of Summit, in the State of Ohio and in the Township of Bath:
Known as and being Sub Lot Number Eight (8) in the Bath Center Estates, as delineated in the Summit County, Ohio Record of Plats, Book 110, Pages 41 through 44. Subject to all matters noted on the plat of Bath Center Estates as recorded in Volume 110, Pages 41 through 44 of the Summit County Plat Records, an easement to the East Ohio Gas Company recorded in Volume 1985, Page 151 of the Summit County Records; an underground easement to the Ohio Edison Company recorded in Volume 6130, Page 490 of the Summit County Records; a non-drilling oil and gas lease recorded in Volume 6959, Page 895 of the Summit County Records; a waiver of plot restrictions recorded in Volume 6842, Page 538 of the Summit County Records, pipeline right-of-way grants to the Bath Oil & Gas Exploration Company recorded in Volume 7136, Page 88 and Volume 7232, Page 365 of the Summit County Records.
Regardless of any other provisions in this deed to the contrary, this deed does not transfer any mineral rights below the surface of aforementioned Sub Lot No. Three (3), Grantors Angelo Plakas & Catherine Plakas their heirs and assigns, specifically reserving all gas and oil rights which lie beneath the surface and further reserving the right to continue to include this parcel as part of a previously unitized parcel of forty (40) acres which has been unitized for the purpose of drilling two gas and oil wells.
Deed Reference Number: Dated August 4, 2014, filed August 21, 2014, recorded as Instrument Number 560868492, Summit County, Ohio records.
Property located at: 3434 Aegean Drive, Akron, OH 44333.
Property appraised at: Three Hundred Nine Thousand Dollars ($309,000.00).
The appraisal was completed based on an exterior view of the property only.
Property cannot be sold for less than 2/3 of the appraised value.
TERMS OF SALE: $10,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.
If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 14th day of April, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))
The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).
The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
