By virtue of an Order of Sale No. CV2023 01 0109to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And known as being a part of Lot 6, Tract 5, formerly Tallmadge Township bounded and described as follows:

Beginning at the Northwest corner of Lot 126 of the Northside Park Subdivision as recorded in Plat Book 30, Pages 68 & 69, Summit County Records and being also on the West line of Lot 6, Tract 5; thence North 5 deg. 27" East, along the West line of Lot 6, a distance of 551.47 feet to a point; thence South 84 deg. 48" East and parallel to the North line of said Northside Park Subdivision, a distance of 500 feet to an iron stake; thence South 5 deg. 27" West, a distance of 328.41 feet to a point and the true place of beginning; thence South 84 deg. 58" East, a distance of 230 feet to an iron stake; thence South 5 deg. 27" West, a distance of 60 feet to an iron stake; thence North 84 deg. 58" West, a distance of 230 feet to a point; thence North 5 deg. 27" East, a distance of 60 feet to a point and the true place of beginning and containing within said boundaries an area of 0.317 of an acre. The Grantor restricts the use of the Westerly 50 feet of the above-described parcel; the same being a part of a private roadway to be used in common with others for roadway to be used in common with others for roadway purposes only. The above-described premises are further known as being a part of Lots No. 28, 29 and 30 of the North View unrecorded allotment also known as Hyde Park, Akron, Ohio. Subject to all restrictions, reservations and limitations of record. Property appraised at: Eighty-one Thousand Dollars ($81,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 7th day of July, 2023. The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
