By virtue of an Order of Sale No. CV2023 01 0021 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Akron, County of Summit and State of Ohio:

And known as being a part of Tract Six, E.P.P. and described as follows:

Beginning at a point in the center line of Fouse Avenue, S. 88 deg. 27 1/2 min. E., 91 feet from the Northwest corner of land deeded by M. W. Fouse to Edwin P. Fouse by deed dated March 23, 1897 and recorded in Vol. 214, Page 388 of Summit County Records; thence S. 3 deg. 21 3/4 min W., 181.5 feet; thence S. 88 deg. 27 3/4 min. E., 60 feet; thence N. 3 deg. 21 3/4 min. E., 181.5 feet to the center of Fouse Avenue; thence Westerly along the center of Fouse Avenue, 60 feet to the place of beginning and containing one-fourth acre of land. Also part of Tract Six (6) E.P.P. and more particularly described as Lot Number Five (5) in Sunnyside Allotment as surveyed and platted February 28th, 1902 by J. A. Gehres, County Surveyor, being Lot Number Five (5) in Sunnyside Allotment made for Edwin P. Fouse as recorded in Plat Book Nine (9), Page Four (4) of the records of plats of Summit County Ohio. The beginning point of the first parcel of land herein described is the point of intersection of the center line of Fouse Avenue and the Easterly line, extended North, of Lot Number Five (5) in Sunnyside Allotment as recorded in Plat Book Nine (9), Page Four (4) of Summit County Records. The property address and tax parcel identification number listed herein are provided solely for information purposes, without warranty as to accuracy or completeness.

Property appraised at: Seventy-eight Thousand Dollars ($78,000.00). 

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 14th day of July, 2023. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
