By virtue of an Order of Sale No. CV2024 01 0150to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

 

FRIDAY, THE 14TH DAY

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

And legally described as Unit No. 109D of the Enclave at Rosemont Ridge Condominium Owners' Association, Inc. (the "Condominium"), according to the declaration recorded on June 8, 2011 in the Summit County Fiscal Office, in Reception Number 55783783 and any amendments thereto.

 

Property located at: 3800 Rosemont Blvd., #109D, Akron, OH 44333.

Property appraised at: Two Hundred Four Thousand Dollars ($204,000.00).

The appraisal was completed based on an exterior view of the property only.

"TO BE SOLD SUBJECT TO THE MORTGAGE OF DEFENDANT, U.S. BANK, NATIONAL ASSOCIATION MORTGAGE. MINIMUM BID SHALL NOT BE LESS THAN 2/3 OF THE DIFFERENCE BETWEEN THE APPRAISED VALUE OF THE REAL ESTATE AND THE AMOUNT REMAINING UNPAID ON THE CLAIM OR OBLIGATION SECURED BY THE MORTGAGE IN FAVOR OF DEFENDANT, U.S. BANK, NATIONAL ASSOCIATION MORTGAGE. APPRAISAL IS $204,000.00. JUDGMENT OF U.S. BANK, NATIONAL ASSOCIATION MORTGAGE IS $100,641.97. $204,000.00 - $100,641.97 = $103,358.03. $103,358.03 X 2/3 = $68,905.35. OPENING BID IS $68,905.35."

TERMS OF SALE: $10,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at https://summit.sheriffsaleauction.ohio.gov on the 28th day of February, 2025. The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
