By virtue of an Order of Sale No. CV2010 11 7913 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, DREW ALEXANDER, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on

FRIDAY, THE 4TH DAY

OF JANUARY, A.D., 2013,

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the Village of Richfield, County of Summit and State of Ohio:

And known as being part of Richfield Township Lot 12, Tract 3, being parcels of land, now or formerly in the name of Jerome P. Stanoch as recorded in Volume 7284, Page 119 of the Summit County Records of Deeds, and more fully described as follows:

Commencing for reference at the centerline intersection of Hart Road (T.R. 379) (60 feet wide) and the Easterly line of said Lot 12, Tract 3, said intersection being the true place of beginning of the parcel herein to be described (2-inch lead-center pipes in monument boxes were found South 89 deg. 52' 00" West at 50.00 feet and 2849.79 feet along the centerline of Hart Road);

Course No. 1: Thence South 00 deg. 17' 06' West, along the Easterly line of Lot 12 and the original centerline of Cleveland-Massillon Road (now 80 feet wide), a distance of 732.23 feet to the Northeasterly corner of a parcel of land, now or formerly in the name of Craig L. and Greta M. Brown as recorded in Official Record Volume 1018, Page 732;

Course No. 2: Thence South 89 deg. 52' 00" West, along the Northerly line of said Brown parcel, passing over an iron pin set at 47.00 feet, a distance of 588.71 feet to the Northwesterly corner of said parcel (a 5/8 inch rebar was found 0.17 North and 0.93 feet East);

Course No. 3: Thence South 00 deg. 17' 06" West, along the Westerly line of said Brown parcel, a distance of 166.26 feet to the Northerly line of a parcel of land, now or formerly in the name of Elnathan P. Morehouse, Jr. and Ralph A. Levi as recorded in Deed Volume 5693, Page 250 (a 5/8 inch rebar was found 0.19 feet North and 1.25 feet East);

Course No. 4: Thence South 89 deg. 50' 20" West, along the Northerly line and the Northerly line of a parcel of land, now or formerly in the name of John Constantine, Jr. and Cynthia Constantine as recorded in Official Records Volume 1979, Page 722, a distance of 290.35 feet to a 5/8 inch rebar found at the Southeasterly corner of a parcel of land now or formerly in the name of Michael Csontos III and Christine F. Csontos as recorded in Deed Volume 7284, Page 119;

Course No. 5: Thence North 00 deg. 17' 06" East, along the Easterly line of said Csontos parcel, a distance of 898.63 feet to a PK nail set on the centerline of aforesaid Hart Road;

Course No. 6: Thence North 89 deg. 52' 00" East, along the centerline of Hart Road, a distance of 879.06 feet to the place of beginning, containing 15.8850 acres (14.5219 acres exclusive of road rights-of-way) of land, more or less, as surveyed in May of 2003 by Robert A. Dorner, Registered Professional Land Surveyor No. 6943 for and on behalf of McSteen and Associates, under Project Number 03-121, and is subject to all legal highways and easements of record.

The basis of bearings for this description is South 89 deg. 52' 00" West, as the centerline of Hart Road, as evidenced by monuments found and is the same bearing shown in Volume 7284, Page 119 of the Summit County Records of Deeds.

Note:

All iron pins set are 1/2-inch diameter x 30 inches in length rebars with a plastic cap stamped "McSteen and Associates".

Property located at: 2636 Brecksville Road, Richfield, OH 44286.

Property appraised at: One Million Five Hundred Thousand Dollars ($1,500,000.00). Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the date of sale.
